OVERVIEW

Welcome to Takteq. The terms “we,” “us,” and “our” refer to Takteq, operated by Nathan Gisvold, LLC. Takteq operates this store and website, including all related information, content, features, tools, products, and services, to provide customers with an online shopping experience (collectively, the “Services”).

Takteq offers small-batch, functional accessories and replacement components. Many products are designed, manufactured, finished, inspected, and packed in Las Vegas, Nevada. Product materials may include nylon-based polymers, including Nylon 12, where identified in the applicable product listing.

Takteq is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when using the Services. Please read them carefully.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You are responsible for supervising any minor who uses the Services through a device you own, purchase, or manage.

To browse, place an order, or use certain Services, you may be asked to provide information such as your name, email address, billing address, payment information, and shipping address. You represent that all information you provide is current, accurate, complete, and that you have the right to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring through your account. You may not transfer, sell, assign, or license your account to another person without our written consent.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately describe and photograph our products. However, product colors, texture, finish, dimensions, and appearance may vary based on your screen, device settings, lighting, photography, manufacturing process, and normal small-batch production variation.

Many Takteq products are manufactured in small batches using polymer-based production methods. Minor cosmetic variation, including layer texture, surface finish, color variation, and small dimensional variation, may occur and does not necessarily constitute a defect.

Product listings identify the specific product, compatible equipment or models, material, color, and included items. Review each listing carefully before ordering.

Images may show products installed on, beside, or used with other equipment for illustration or compatibility purposes. Unless expressly stated in the product listing, host equipment, firearms, magazines, optics, tools, batteries, screws, accessories, and other items shown in photographs are not included.

Certain products may be aftermarket accessories or replacement components intended for use with specific equipment. Compatibility depends on the exact manufacturer, model, generation, configuration, modifications, tolerances, and condition of the customer’s equipment. You are responsible for confirming compatibility before purchase and installation.

References to third-party brands, product names, trademarks, or model names are used solely to identify compatibility. Takteq is not affiliated with, sponsored by, endorsed by, or authorized by those third-party trademark owners unless expressly stated otherwise.

Unless a product listing expressly says otherwise, Takteq products are not represented as original equipment manufacturer products, factory-original parts, safety-critical components, or certified for any particular use.

You are responsible for using all products safely, lawfully, and according to applicable instructions. Do not use a product if it appears damaged, improperly installed, incompatible, loose, binding, unreliable, or otherwise unsafe. Where installation requires specialized knowledge, tools, or safety procedures, seek assistance from a qualified professional.

You are solely responsible for determining whether the purchase, possession, installation, use, transfer, resale, or export of a product is lawful in your location. We may decline or cancel orders where sale, shipment, use, or possession may be prohibited or restricted.

All product descriptions are subject to change without notice. We may discontinue products, correct listing errors, or limit quantities available to any person, household, geographic area, or jurisdiction.

SECTION 3 - ORDERS

When you submit an order, you are making an offer to purchase products from Takteq. We reserve the right to accept, decline, limit, or cancel an order for any lawful reason, including suspected fraud, pricing errors, inventory availability, shipping restrictions, or suspected resale or export activity.

An order is not accepted until we confirm acceptance and process payment. We may be unable to accommodate cancellation or address-change requests after an order has been submitted, processed, or transferred to a shipping carrier.

If we decline, modify, or cancel an order, we will attempt to notify you using the contact information provided at checkout.

Purchases are subject to our Refund Policy and Shipping Policy.

Unless we approve otherwise in writing, purchases are for personal, household, or end-user use only and may not be purchased for commercial resale, redistribution, export, or unlawful use.

SECTION 4 - PRICES AND BILLING

Prices, discounts, promotions, product availability, and shipping offers may change without notice. The price charged will be the price displayed at checkout when you place your order, subject to correction of obvious errors.

Unless stated otherwise, prices do not include applicable sales tax, shipping, handling, customs, duties, import fees, or similar charges. Applicable taxes and shipping charges will be shown at checkout where required.

You agree to provide accurate, complete, and current purchase, billing, payment, and account information. You agree to promptly update your information so that we can process transactions and contact you regarding your order.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to charge the total amount due, including applicable taxes and shipping charges.

SECTION 5 - SHIPPING AND DELIVERY

Orders are generally packed and shipped from Nevada. Shipping methods, estimated delivery dates, and shipping charges are shown at checkout or in our Shipping Policy.

Delivery dates are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, incorrect addresses, supply interruptions, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. We are not responsible for packages delayed, lost, returned, or misdelivered because of an incorrect, incomplete, inaccessible, or undeliverable address provided by you.

Title and risk of loss are determined under applicable law. If a package is marked delivered but cannot be located, contact the carrier and us promptly so we can review available options.

SECTION 6 - RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, replacements, exchanges, and cancellations are governed by our Refund Policy, available at https://takteq.com/policies/refund-policy

Do not return an item without following the return instructions in our Refund Policy or receiving authorization from Takteq when required.

Products that have been installed, modified, damaged, altered, used in an unsafe manner, or returned without required components may be ineligible for return, refund, exchange, or replacement, subject to applicable law and our Refund Policy.

SECTION 7 - INTELLECTUAL PROPERTY

The Services and their contents, including trademarks, logos, product names, text, product descriptions, images, graphics, videos, designs, product renders, downloads, and the arrangement of those materials, are owned by or licensed to Takteq and are protected by applicable intellectual-property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, scrape, or exploit any part of the Services without our prior written permission.

Takteq, Recycled Brand, and related product and service names, logos, designs, and slogans are trademarks or trade names of Takteq or its licensors. You may not use them without prior written permission.

Third-party trademarks appearing on the Services belong to their respective owners and are used only for identification or compatibility purposes where applicable.

SECTION 8 - OPTIONAL TOOLS

We may provide access to third-party tools, integrations, payment providers, shipping providers, or other services that we do not own or control.

You acknowledge that optional third-party tools are provided “as is” and “as available,” without warranties or endorsements by Takteq. Your use of those tools is at your own risk and subject to the third party’s terms and policies.

Any future features, tools, resources, or services we make available through the Services will also be subject to these Terms.

SECTION 9 - THIRD-PARTY LINKS

The Services may contain links to third-party websites, materials, or functionality. We do not control or evaluate third-party content, products, services, or websites.

If you choose to access a third-party website, you do so at your own risk. Takteq is not responsible for harm, loss, or damages arising from your use of third-party websites, products, services, or content.

Questions or complaints concerning third-party products or services should be directed to the applicable third party.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Takteq is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Takteq. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Takteq, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Takteq.

SECTION 11 - PRIVACY POLICY

Because the Services are hosted by Shopify, Shopify may collect and process personal information related to your access to and use of the Services. Information you submit through the Services may be transmitted to Shopify and service providers that help us operate our store, process payments, ship orders, prevent fraud, provide customer service, or comply with legal obligations.

By using the Services, you acknowledge that you have read our Privacy Policy and Shopify’s applicable privacy policies.

SECTION 12 - FEEDBACK AND REVIEWS

If you submit reviews, feedback, ideas, suggestions, photographs, comments, proposals, or other content (“Feedback”), you grant Takteq a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, display, and otherwise use that Feedback for business, promotional, operational, and commercial purposes.

You represent that you own or have all necessary rights to submit the Feedback and that it does not violate another person’s rights or applicable law.

We may, but are not required to, monitor, edit, remove, or decline Feedback that we believe is unlawful, misleading, abusive, threatening, defamatory, infringing, or otherwise objectionable.

SECTION 13 - ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, compatibility, pricing, promotions, shipping charges, estimated transit times, inventory, or availability.

We reserve the right to correct errors, update information, change product information, or cancel orders affected by an error or inaccuracy at any time, including after an order has been submitted.

SECTION 14 - PROHIBITED USES

You may use the Services only for lawful purposes. You may not use the Services, directly or indirectly, to:

Violate any applicable law, regulation, ordinance, or third-party right;
Purchase, possess, use, transfer, export, or resell products in a manner prohibited by law;
Infringe our intellectual-property rights or the rights of another person;
Harass, threaten, abuse, defame, or harm Takteq personnel, customers, or others;
Submit false, misleading, fraudulent, or stolen information;
Upload or transmit viruses, malware, or harmful code;
Send spam, chain letters, unsolicited advertising, or deceptive communications;
Impersonate another person or entity;
Access, scrape, copy, extract, monitor, or use data from the Services through robots, spiders, crawlers, automated tools, AI agents, or manual means without our written authorization;
Bypass, interfere with, or circumvent security measures, access controls, CAPTCHA systems, rate limits, or other restrictions on the Services; or
Use the Services in a way that could damage, disable, overburden, interfere with, or impair the Services.

We may suspend, restrict, or terminate your access to the Services if we believe you have violated these Terms.

SECTION 15 - AUTOMATED AGENTS

No automated agent, bot, crawler, software process, or artificial-intelligence system may access, use, or interact with the Services without our prior written permission.

Authorized automated access must clearly identify itself in its user-agent string, comply with our technical restrictions and robots directives, and may not imitate human interaction, bypass CAPTCHAs, evade access controls, or conceal its automated nature.

We may limit, block, suspend, or technically restrict automated access at any time.

SECTION 16 - TERMINATION

We may terminate or restrict your access to the Services, cancel an order where permitted by law, or discontinue any part of the Services at our discretion.

Termination does not affect obligations incurred before termination, including payment obligations, intellectual-property rights, limitations of liability, indemnification obligations, and any provisions that by their nature should survive termination.

SECTION 17 - DISCLAIMER OF WARRANTIES

We make reasonable efforts to provide accurate product information, but product listings, compatibility information, instructions, and other content are provided for general informational purposes.

Except where expressly stated in a separate written warranty or required by applicable law, the Services and products are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Takteq does not guarantee that the Services will be uninterrupted, error-free, secure, or free from defects.

Nothing in these Terms limits, excludes, or modifies rights or warranties that cannot lawfully be limited, excluded, or modified. Any written warranty offered by Takteq will be governed by its own terms.

SECTION 18 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, Takteq and its owners, employees, contractors, affiliates, licensors, service providers, and Shopify and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, replacement costs, or business interruption, arising from or related to your use of the Services or products purchased through the Services.

To the fullest extent permitted by law, Takteq’s total liability for any claim arising from a product or order will not exceed the amount you paid to Takteq for the specific product or order giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Takteq, Shopify, and their respective affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising from:

Your breach of these Terms or applicable policies;
Your violation of applicable law or the rights of another person;
Your unlawful, improper, unsafe, or unauthorized use of products purchased through the Services; or
Your access to or use of the Services.

SECTION 20 - SEVERABILITY

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law. The remaining provisions will remain in full force and effect.

SECTION 21 - WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, and any other policies posted on the Services, constitute the entire agreement between you and Takteq regarding the Services and supersede prior or contemporaneous communications or agreements regarding the Services.

SECTION 22 - ASSIGNMENT

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent.

We may assign, transfer, or delegate these Terms and our rights or obligations in connection with a merger, acquisition, sale of assets, reorganization, or other business transaction.

SECTION 23 - GOVERNING LAW AND VENUE

These Terms and any dispute arising from or related to the Services or products purchased through the Services are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

To the extent permitted by law, you and Takteq agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in Clark County, Nevada. Nothing in this section prevents either party from seeking relief in a court of competent jurisdiction where required by applicable law.

SECTION 24 - CHANGES TO THESE TERMS

You may review the current version of these Terms at any time on this page.

We may update these Terms from time to time by posting the revised version on the Services. Changes become effective on the effective date shown in the updated Terms, unless otherwise required by law.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.
